1. Acceptance

By downloading, installing, accessing, or using Kickzuru (the “Service”), including the desktop or mobile clients, websites at godgamers.ro, and related APIs, you agree to these Terms of Service (“Terms”). If you do not agree, do not use the Service.

Kickzuru is a product developed by MarkSoft. The public Service is operated at godgamers.ro. MarkSoft’s company site (marksoft.ro) is provided for developer credit and is not the download or API host.

2. The Service

Kickzuru provides multi-view stream watching, community chat, watch-time and activity tracking, loyalty points, a streamer card economy, AI-assisted creation tools (music, images, and video), a community feed for sharing creations, in-app media, Discord bot integration, roster and organization tools, scheduling, and related features for streamer communities. Features may change as we improve the product. Availability of platforms (Windows, macOS, Linux, Android, and others) may vary over time.

3. Organizations and licensing

Access for a community (“Organization” or “org”) may require a valid license arrangement as described on the Kickzuru download site, including without limitation:

• A monthly Kick subscription to kick.com/13thomas as the app license for the org; and
• A one-time server setup contribution of 50000 KICKs gifted to 13thomas, where that setup fee applies.

If a required subscription lapses, org access may pause until the subscription is restored. License fees paid through Kick are subject to Kick’s own terms and payment systems; Kickzuru does not process those payments directly.

4. Accounts, whitelist, and roles

You may sign in with supported third-party identity providers (such as Kick or Twitch). Membership in an Organization typically requires whitelist approval by that Organization’s managers or administrators. You are responsible for activity under your account and for keeping credentials and tokens secure.

Organization operators are responsible for managing their members, roles, and permissions in accordance with these Terms and applicable law.

5. Virtual items and credit

The Service includes virtual items and balances such as KICK credit, coins, loyalty points, card packs, and streamer cards (collectively, “Virtual Items”). Virtual Items:

• Are a limited, revocable license to features within the Service - not money, property, or a currency;
• Have no cash value and are not redeemable, exchangeable, or transferable outside the Service;
• May be adjusted, rebalanced, or reset as part of operating the Service (for example, seasonal or org-level resets);
• Are forfeited if your account or Organization access is terminated for violating these Terms.

Charges for AI generation are deducted from your KICK credit and recorded in your activity ledger. Failed AI generations are automatically refunded to your credit. Top-ups and gifts made through Kick are processed by Kick under Kick’s own terms; Kickzuru does not process those payments directly and cannot reverse them.

6. AI-generated content and the community feed

The Service offers AI-assisted creation of music, images, and video, processed in part by third-party AI providers. When you use these tools you agree that:

• You are responsible for the prompts, lyrics, voice samples, and other inputs you submit, and you must have the rights to submit them (including any voice you clone);
• You will not generate content that is unlawful, infringing, hateful, or that impersonates real people without their consent;
• Content you share to the community feed or post to org chat becomes visible to other users; you grant Kickzuru a non-exclusive license to host, display, and distribute it within the Service;
• AI outputs may be inaccurate or similar to outputs generated for others; availability of specific models and tools may change at any time;
• We may remove shared content and restrict access to the tools for violations.

7. Acceptable use

You agree not to:

• Abuse, disrupt, or overload the Service, APIs, or infrastructure;
• Attempt unauthorized access to accounts, data, or systems;
• Reverse engineer, scrape, or circumvent security or access controls except where permitted by law;
• Farm, exploit, or automate watch time, points, coins, card drops, or other Virtual Item mechanics;
• Use the Service to harass, defraud, or violate the rights of others;
• Violate Kick, Twitch, or other platform terms while using embedded players or related features;
• Misrepresent affiliation with Kickzuru or MarkSoft.

We may suspend or terminate access for violations or to protect the Service and its users.

8. Third-party platforms and embeds

Kickzuru embeds or links to third-party services (including Kick and Twitch players, authentication, AI generation providers, and related scripts). Those services are governed by their own terms and privacy policies. Content, ads, analytics, or DRM loaded by a platform player are not controlled by Kickzuru’s application shell. Embedded players may offer their own sign-in so that follows and age-gated streams work; that sign-in is with the platform, not with Kickzuru. We are not responsible for third-party outages, policy changes, or content.

9. Intellectual property

Kickzuru, its branding, software, and documentation are owned by MarkSoft or its licensors. These Terms grant you a limited, revocable, non-exclusive, non-transferable right to use the client and Service for lawful community and personal use as intended. You may not copy, redistribute, or resell the software except as we expressly allow (for example, official installers from godgamers.ro).

10. Privacy overview

The Service processes account identifiers, organization membership, watch-time and app-activity metrics, loyalty points and Virtual Item balances, org community chat messages, content you create or share through the AI tools and community feed, configuration, and similar operational data needed to provide the Service. Data is stored and processed on Kickzuru infrastructure associated with godgamers.ro.

Kickzuru does not capture or store Kick or Twitch chat messages. Only your Organization’s own community chat is stored, so that the chat feature can function. Inputs you submit to the AI tools (such as prompts, lyrics, or voice samples) are shared with the relevant AI provider to generate your content. Do not submit sensitive personal data that the product is not designed to collect.

11. Disclaimers

THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE,” WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT, TO THE MAXIMUM EXTENT PERMITTED BY LAW. We do not warrant uninterrupted or error-free operation, that third-party embeds or AI providers will always function, or that AI outputs will meet your expectations.

12. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, MARKSOFT AND KICKZURU SHALL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR LOSS OF PROFITS, DATA, VIRTUAL ITEMS, OR GOODWILL, ARISING FROM YOUR USE OF THE SERVICE. OUR AGGREGATE LIABILITY FOR CLAIMS RELATING TO THE SERVICE SHALL NOT EXCEED THE AMOUNTS YOU PAID (IF ANY) FOR THE SERVICE IN THE TWELVE MONTHS BEFORE THE CLAIM, OR ONE HUNDRED EURO IF YOU HAVE NOT PAID US DIRECTLY.

13. Changes

We may update these Terms from time to time. The “Last updated” date above will change when we do. Continued use of the Service after changes become effective constitutes acceptance of the revised Terms. Material changes may also be communicated through the site or the application when practical.
